Terms of Service

The agreement between you and the HostFasts entity named on your invoice, for hosting, domain and related services.

1. Who you are contracting with

HostFasts is a trading brand of SmartShield Cyber Security Company ("we", "us", "our"). Depending on your country of establishment, your services may be invoiced by that entity or by an affiliated HostFasts entity in the Gulf. The supplying entity, its registration details and its VAT or GST registration number are stated on your quotation and on every invoice we issue to you. These terms govern your use of any service ordered through hostfasts.com.

We are an authorised reseller. Datacentre facilities, network and physical hardware are operated by our upstream infrastructure partners. Account provisioning, configuration, security hardening, billing and first-line support are provided by us. Your contract for the service is with us.

2. Accounts and eligibility

  • You must be at least 18 years old, or ordering on behalf of a legally constituted entity.
  • The information you give us at signup must be accurate and kept current. Domain registrations in particular require accurate registrant details under registry rules, and restricted Gulf registries require supporting documentation.
  • You are responsible for keeping your credentials confidential and for everything done under your account.
  • Tell us promptly if you believe your account has been compromised.

3. Fees, tax and renewals

  • All prices published on this site are exclusive of VAT and GST. Tax is applied at the rate in force in your jurisdiction at the time of invoicing — currently 15% in Saudi Arabia, 5% in the United Arab Emirates and Oman, 10% in Bahrain, nil in Qatar, and 18% GST in India.
  • Where the supply is an export of services and the reverse charge applies, tax is accounted for by you rather than charged by us. Your invoice states which treatment has been applied.
  • Prices are listed in US dollars for our Gulf markets and in Indian rupees for India. Invoices may be issued in another currency on request, converted at the rate in force on the invoice date.
  • Services are billed in advance, monthly or annually, as selected at order.
  • Your renewal rate is the rate you signed up on, unless we notify you in writing before the renewal date.
  • Domain registration, renewal and transfer fees follow registry pricing and may change. The rate confirmed on your quotation applies to that term only.
  • Where an invoice remains unpaid, we may suspend the service. Accounts suspended for non-payment may be terminated and data deleted after a further 30 days.

4. Acceptable use

You may not use our services to host, transmit or link to:

  • Content that is unlawful in the jurisdiction in which it is hosted or in which you operate. Note that content standards in the GCC states differ from those elsewhere, and you are responsible for compliance in the country whose infrastructure you have chosen.
  • Malware, phishing pages, credential harvesting, botnet control infrastructure or exploit kits.
  • Unsolicited bulk email, or any list not built on verifiable consent.
  • Material that infringes copyright, trade marks or other intellectual property rights.
  • Content depicting child sexual abuse, or material inciting violence or hatred.
  • Activity that degrades the platform for other customers — sustained resource abuse, cryptocurrency mining, public file mirrors, or open proxies.

We investigate reports of abuse. Where content is clearly unlawful or actively harmful we may suspend immediately; otherwise we will normally contact you first and give you a reasonable opportunity to remedy it.

5. Resource use on shared plans

Shared hosting bandwidth is metered and stated on each plan, from 5 GB a month to 500 GB. Exceeding it does not trigger an automatic overage charge — we contact you and either move you up a tier or help you onto a VPS. Disk, CPU, memory and input/output are likewise bounded by the plan you hold. Where a single account consistently affects other customers on the same node we will contact you first, except where the load is causing an active outage.

6. Region and data location

You select the datacentre region when you order. Where you have told us in writing that your data must remain in a named country, we will place and keep it there for the duration of the service and confirm that placement to you. We will not move your data to another region without your prior written agreement, except where required by law.

7. Backups

We take server-level backups for platform disaster recovery and will assist with restores where we reasonably can. These are our backups, for our recovery purposes. They are not a substitute for your own. You remain responsible for maintaining independent copies of your data. We do not accept liability for data loss where you have not kept your own backup.

8. Availability

We commit to 99.9% monthly uptime, with service credits as set out in our Service Level Agreement. Scheduled maintenance is notified in advance wherever practicable and is excluded from uptime calculations.

9. Suspension and termination

  • You may cancel at any time. Cancellation takes effect at the end of your current billing term unless a refund applies under our refund policy.
  • We may suspend or terminate for breach of these terms, for non-payment, or where required by law or by a competent authority.
  • On termination we may delete your data after 30 days. Export anything you need before then.

10. Liability

Nothing in these terms limits liability for fraud, or for anything that cannot be limited under applicable law. Subject to that, our total liability to you in any twelve-month period is limited to the fees you paid us for the affected service during that period. We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data where you have not maintained your own backup.

11. Changes to these terms

We may update these terms. Material changes will be notified by email to your account address at least 30 days before they take effect. Continuing to use the service after that date constitutes acceptance.

12. Governing law and disputes

These terms are governed by the law of the country in which the supplying HostFasts entity named on your invoice is established, and the competent courts of that country have jurisdiction. Where that entity is SmartShield Cyber Security Company, the governing law is that of India and the courts at Chennai have exclusive jurisdiction.

Before commencing proceedings, both parties agree to attempt to resolve the dispute in good faith by escalation to senior representatives.
